Acceptance
By installing or using This is My Life you agree to these terms. If you do not agree, do not use the app. Your use of the App Store or Google Play is separately governed by Apple's or Google's own terms, and where those conflict with these for matters within their control, theirs prevail.
Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use This is My Life on devices you own or control, for your own purposes. You may not copy, redistribute, sell, sublicense, reverse engineer or attempt to derive the source code of the app, except to the extent that such a restriction is unenforceable under applicable law.
Not a backup service
This is My Life is not a backup service, and it is not a substitute for keeping your own copies of anything you would be upset to lose. On iOS your story is stored on your device and in your own iCloud, under your Apple Account; on Android it is stored on your device. In both cases the durability of that storage is a matter between you, your device and your platform provider.
We cannot recover a story you have deleted, a device you have lost, or an iCloud account you can no longer sign in to, because we hold no copy of any of it. Use the export in Settings to keep your own archive, and keep it somewhere you control.
Your content
Everything you put into the app — your moments, photos, videos, dates, places and the words you write — remains yours. We claim no licence over it, make no use of it, and never see it. You are responsible for having the right to include what you include: photographs of other people, family details that are not only yours to share, and anything you did not create yourself.
If you share a moment out of the app — as a card, an export or a presentation — you are publishing it yourself, to a place of your choosing, and what happens to it there is outside the app's control and ours.
Devices and storage
On iPhone and iPad the app stores your story on the device and in your own iCloud. On Android it stores it on the device. There is no account with us, no server of ours in the path, and consequently no copy of your story anywhere we can reach.
The iOS and Android apps are separate builds with separate storage. Nothing you enter in one appears in the other unless you export it from one and import it into the other yourself.
Third-party services
The app relies on Apple's iCloud on iOS, and on the App Store and Google Play for distribution and billing. Your use of those services is governed by Apple's and Google's own terms and privacy policies. We are not responsible for their availability, their pricing, their handling of your files, or changes they make that affect the app.
Acceptable use
Use the app only for content you are lawfully entitled to store and share, and only in a manner permitted by applicable law. Do not use it to store or publish another person's personal information, photographs or family details where doing so would breach their rights or their reasonable expectation of privacy.
Availability and changes
The app is provided as-is and we may change, suspend or discontinue it, or any of its features, at any time. Features that depend on platform services may stop working without notice if those services change. We may update these terms; continued use after an update constitutes acceptance of the revised terms.
Disclaimer of warranties
To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that any story, export or backup will remain intact or readable.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these terms limits any right you have under consumer protection law that cannot lawfully be limited, including under the Consumer Protection Act, 2008 (South Africa).
Limitation of liability
To the fullest extent permitted by law, TidyByte Development shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, content, profits, revenue or goodwill, arising out of or in connection with your use of This is My Life, however caused. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid for the app in the twelve months preceding the claim, or ZAR 500.
Governing law
These terms are governed by the laws of the Republic of South Africa, and you agree to the non-exclusive jurisdiction of the South African courts, without prejudice to any right you may have to bring proceedings in your country of residence under mandatory local law.
